Contract translation — FAQ
Is a certified translation enough for a Canadian court, or do I need a sworn translator?
In Canada, the terms "certified translation" and "sworn translation" are used interchangeably — both refer to a translation produced by a translator accredited by a CTTIC-affiliated provincial order. This is what Canadian courts, tribunals, and notaries require. The "sworn translator" terminology is more common in civil-law jurisdictions (France, Quebec, Latin America), but the Canadian standard is the same.
Can you translate a contract that has already been signed?
Yes, and this is one of the most frequent requests. Translated signed contracts are often needed for litigation, evidence in court, due diligence in M&A transactions, or for one party to formally understand the binding terms they agreed to. The signatures, dates, and any handwritten amendments are described in the translation, but the original signed document remains the legally binding instrument.
Will the translated contract be legally binding on its own?
Usually no — and this is intentional. A translation reproduces the content of the original contract, but the legally binding version is generally the one explicitly designated in the contract's "governing language" clause. For bilingual agreements (common in Quebec), both versions may be equally binding if the contract says so. We always confirm the intended legal status with the client before finalizing.
